IU Student Won't Face Discipline For Porn Site

Dean: Freshman Hasn't Broken Laws, Regulations

Indiana University won't punish a female student for posing topless for a Web site, the school's dean of students said Monday.

The school last week said it was investigating the freshman, who posed for a pay-to-view site that claimed the pictures were taken in her dormitory room and the shower of her residence hall, Indianapolis television station RTV6 reported.

Dean of Students Richard McKaig said Monday that officials determined the student broke no laws and violated no campus regulations.

The site is run by a Raleigh, N.C., company and has photos of the freshman, who uses a pseudonym, posed topless and seminude.

"It was agreed that this is a situation like those in the past when students have posed for Playboy," McKaig said Monday. "The university does not condone the activity, but it is also outside of the university to control it."

McKaig said that he considered the photos of the student in a shower area and a residence hall room as "incidental uses" of IU property that were not exploitative and could not be clearly identified as IU property. An evacuation notice on the back of a door is the only place where "IU" can be seen in print.

The school's code of student conduct says IU can discipline a pupil for lewd, indecent or obscene conduct on university property. IU said that if violations were found, the woman could have faced probation or expulsion.

The student said in interviews with the Indiana Daily Student that she posed for the photos to make money to pay for school.

The site was not the first pornography case to concern IU officials. In 2002, a movie company shot part of a pornographic movie in an IU dorm room, and students who participated were charged through the campus judicial system, RTV6 reported.

IU said it punished the students involved in the 2002 incident, but it didn't elaborate.
